Time for Compact Disc

For this semester I will be offering TFCD (Time for Compact Disc). TFCD is an agreement between the model and photographer to offer their services at no cost. In return, the Model will be compensated for their time with a compact disc or digital versatile disc of a selection of images from the shoot.

Further Information:
1.) My studio is a home studio that is setup in my grandparents garage.
2.) Before/After the shoot you will possibly meet my grandparents, father and my brother.
3.) Other family members may show up at my grandparents house at anytime.
4.) During the shoot there will be minimal interference from my family. They will be fully aware of the situation.
5.) Please bring any clothing you would like to change into and any props that you would like to use.

Information below this photograph will include an example contract and two videos from Tryra Banks on how to apply your own makeup. Makeup, Hair and Transportation is the responsibility of the model.

This is NOT an official contract.

Time for Compact Disk

Whereas Charles Showalter, Photographer and __________________________________________(print Model’s name), Model, have agreed to enter this agreement for the purpose of “time for compact disc” whereby the Photographer will provide photography services to the Model at no cost to the model and Model will provide modeling services to Photographer at no cost to the photographer, both in accordance with the following Definitions and Provisions.

PROVISIONS:

Copyright Ownership
Photographer retains sole copyright of all images produced.

Proofs
The Photographer will not provide any proofs to the model.

Prints
The Photographer will provide the Model with a selection of images on a compact disc (CD) or digital versatile disc (DVD). All images will be fully retouched and portfolio grade. All images will be sized for 8×10 prints, which will be the responsibility of the model to have printed.

Reproduction Rights Granted to Model
Photographer grants Model nontransferable and nonexclusive reproduction rights to the images. Model shall not transfer, license, sell, lease or otherwise confer either permanently or temporarily any reproduction rights to any images, to any third party. Images may be reproduced in print or electronically (such as e-mail or on the world wide web). If images are reproduced electronically please give credit back to the Photographer.

Reproduction Rights Granted to the Photographer
Photographer may only use the images for self-promotion efforts, including, but not limited to: printed portfolio, electronic portfolio, photo contests, or electronically (such as on the world wide web). In no case will indentifying information about the Model be posted in public venue. Photographer will not use licenses or sell images for commercial use without contacting the Model and negotiating a new contract.

Entire Agreement
This Agreement contains the entire understanding of the Photographer and Model and supersedes and cancels all previous negotiations, agreements, commitments, understandings, and writings in connection with the subject matter of this Agreement. This Agreement may not be released, discharged, abandoned, supplemented, amended, or modified in any manner except by a written instrument duly executed by the Photographer and Model and shall not be strictly construed against either party.

THIS IS NOT A CONTRACT OR AGREEMENT FOR WORK FOR HIRE. THE IMAGES ARE NOT THE PRODUCT OF A WORK FOR HIRE.
